1. Introduction

Welcome to VisaStack (the "Platform"), operated by Obsidian Global Studio ("we," "us," or "our"). By accessing or using our Platform, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use the Platform.

VisaStack is a business-facing platform for employers, travel agencies, law firms, and service providers managing corporate mobility, immigration cases, and visa workflows. We provide software tools for document management, AI-powered data extraction, case tracking, and vendor ecosystem connections.

2. Acceptance of Terms

By creating an account, uploading documents, or using any feature of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

  • You must be at least 18 years old to use the Platform
  • You represent that all information provided is accurate and complete
  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to notify us immediately of any unauthorized access to your account

3. Services Provided

3.1 Core Platform Features

  • Employee roster management for corporate visa applications
  • Multi-mission visa journey management
  • Document upload, storage, and AI-powered extraction
  • Master Profile creation and management
  • Case tracking and deadline management
  • Letter and template generation for visa applications
  • Document intelligence and visa preparedness tracking
  • Checklists and application readiness assessment

3.2 Vendor Ecosystem

  • Connect with licensed immigration attorneys and law firms
  • Travel agency integration for flight and accommodation bookings
  • Service provider marketplace for visa-related services
  • Secure data sharing with granular consent controls
  • Vendor reviews and transparent pricing

3.3 AI-Powered Features

Our Platform uses Google Gemini AI to extract data from uploaded documents (passports, visas, bank statements, etc.). While we strive for accuracy, AI extraction may contain errors. You are responsible for reviewing and verifying all extracted data before submission to embassies or immigration authorities.

4. User Responsibilities

4.1 Accuracy of Information

You are solely responsible for the accuracy, completeness, and legality of all information and documents you upload to the Platform. We do not verify the authenticity of documents or the accuracy of information provided.

4.2 Prohibited Activities

You agree NOT to:

  • Upload fraudulent, forged, or falsified documents
  • Misrepresent your identity, qualifications, or travel history
  • Use the Platform for illegal immigration activities
  • Share your account credentials with others
  • Reverse engineer, decompile, or attempt to extract source code
  • Use automated tools (bots, scrapers) to access the Platform
  • Interfere with or disrupt the Platform's operation
  • Violate any applicable laws or regulations

4.3 Data Security

You are responsible for implementing appropriate security measures on your devices. We recommend:

  • Using strong, unique passwords
  • Enabling two-factor authentication (2FA) where available
  • Logging out from shared or public devices
  • Keeping your contact information up to date

5. No Legal or Immigration Advice

IMPORTANT: The Platform provides tools and information to assist with visa application preparation. We do NOT provide legal advice, immigration consulting, or guarantee visa approval.

  • Information provided is for general guidance only and may not reflect current laws or policies
  • Visa requirements vary by country, nationality, and individual circumstances
  • We recommend consulting licensed immigration attorneys or authorized representatives
  • Embassy decisions are final and at their sole discretion
  • We are not responsible for visa refusals, delays, or travel restrictions

6. Intellectual Property

6.1 Our Rights

All content, features, functionality, trademarks, and intellectual property on the Platform are owned by Obsidian Global Studio or our licensors and are protected by copyright, trademark, and other laws.

6.2 Your Rights

You retain ownership of all documents and data you upload to the Platform. By uploading content, you grant us a limited, non-exclusive, royalty-free license to:

  • Store and process your data to provide the Services
  • Use AI models to extract data from documents
  • Display your content back to you and authorized parties (e.g., connected vendors)
  • Aggregate anonymized data for analytics and service improvement

6.3 AI Training

We do NOT use your personal documents or data to train AI models. We use third-party AI services (Google Gemini) for document extraction only. Please refer to our Privacy Policy for details.

7. Payment and Fees

7.1 Free and Paid Services

We offer both free and paid features. Pricing is displayed on our website and may change with 30 days' notice.

7.2 Billing

  • Subscriptions are billed in advance (monthly or annually)
  • Payments are non-refundable except as required by law
  • You authorize us to charge your payment method on file
  • Failure to pay may result in account suspension or termination

7.3 Vendor Fees (VisaStack)

Service providers, law firms, and travel agencies may charge separate fees for their services. These fees are between you and the vendor. We are not responsible for vendor billing disputes.

8. Data Privacy and Security

Your privacy is important to us. Our data practices are detailed in our Privacy Policy. Key points:

  • We use industry-standard encryption (TLS/SSL) for data transmission
  • Documents are stored securely in Firebase Cloud Storage and PostgreSQL
  • Access controls limit who can view your data (you + authorized vendors)
  • We comply with GDPR, CCPA, and applicable data protection laws
  • You can export or delete your data at any time

9. Third-Party Services

The Platform integrates with third-party services:

  • Google Gemini AI - Document extraction and analysis
  • Firebase - Authentication and storage
  • Vercel - Hosting and deployment
  • Resend - Email delivery
  • OAuth Providers - Google, LinkedIn for authentication

These services have their own terms and privacy policies. We are not responsible for third-party practices.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE ARE NOT LIABLE FOR VISA REFUSALS, TRAVEL DELAYS, OR FINANCIAL LOSSES
  • WE ARE NOT RESPONSIBLE FOR ERRORS IN AI EXTRACTION OR DATA PROCESSING
  • WE ARE NOT LIABLE FOR ACTIONS OF THIRD-PARTY VENDORS ON THE PLATFORM
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 12 MONTHS
  • WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES

Some jurisdictions do not allow limitations on warranties or liability, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Obsidian Global Studio, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of any third-party rights
  • Fraudulent or misleading information you provide
  • Your use of the Platform or Services

12. Account Termination

12.1 By You

You may close your account at any time through Account Settings. Upon closure:

  • Your access will be terminated immediately
  • We will retain data as required by law (7 years for financial records)
  • You may request data deletion (subject to legal retention requirements)
  • No refunds will be issued for unused subscription time

12.2 By Us

We may suspend or terminate your account if:

  • You violate these Terms
  • Your account shows suspicious or fraudulent activity
  • You fail to pay subscription fees
  • Required by law or court order
  • We cease operations (with 30 days' notice)

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the People's Republic of Bangladesh, without regard to conflict of law provisions. Any legal disputes shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.

13.2 Arbitration

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except for claims that may be brought in small claims court.

13.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or representative proceedings.

14. Changes to Terms

We may update these Terms from time to time. When we do:

  • We will update the "Last Updated" date at the top
  • We will notify you via email or in-app notification for material changes
  • Continued use of the Platform after changes constitutes acceptance
  • If you disagree, you must stop using the Platform and close your account

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Obsidian Global Studio regarding the use of the Platform and supersede all prior agreements and understandings.
